Türkiye Cumhuriyeti Dışişleri Bakanlığı, Türkiye'de yerleşik tüm yabancı misyonlara saygılarını sunar ve Bakanlığın 12 Ekim 2005 tarih ve PDGY/429252 sayılı Notasına atıfla, aşağıdaki hususları bildirmekten onur duyar.

 Türkiye'de yerleşik yabancı misyonlarda istihdam edilen Türk uyruklu veya Türk uyruklu olmamakla birlikte Türkiye'de yerleşik yerel personelin 506 sayılı Sosyal Sigortalar Kanunu gereğince, ikili Sosyal Güvenlik Anlaşmaları hükümleri saklı kalmak kaydıyla, sigortalı olmaları zorunludur.

 Kanunun 2.maddesinde, bir hizmet akdine dayanarak bir veya birkaç işveren tarafından çalıştırılanların bu kanuna göre sigortalı sayıldığı,

  79. maddesinde, işverenin, bir ay içinde çalıştırdığı sigortalının primleri ve destek primi hesabına esas tutulan kazançlar toplamı ve prim ödeme gün sayıları ile bu primleri gösteren ve örneği yönetmelikle belirlenen asıl veya ek belgeleri ait olduğu ayı veya dönemi takip eden ayın sonuna kadar Kuruma vermekle ve Kurumca istenilmesi halinde işyeri kayıtlarını ibraz etmekle veya sigortalı çalıştırmadığı takdirde, bu hususu sigortalı çalıştırmaya son verdiği tarihten itibaren bir ay içinde yazılı olarak Kuruma bildirmekle yükümlü olduğu,

 80.maddesinde ise, işverenin, bir ay içinde çalıştırdığı sigortalıların primlerine esas tutulacak kazançlar toplamı üzerinden bu Kanun gereğince hesaplanacak prim tutarlarını ücretlerinden kesmeye ve kendisine ait prim tutarlarını da bu miktara ekleyerek en geç ertesi ayın sonuna kadar Kuruma ödemeye mecbur olduğu hükme bağlanmıştır.

The Ministry of Foreign Affairs of the Republic of Turkey presents its compliments to All Foreign Missions Accredited to Turkey and with reference to its Note Verbal dated 12 October 2005, No. PDGY/429252, has the honor to inform the following:

In accordance with the Social Insurance Law No.506, except as provided in the Bilateral Social Security Agreements, Turkish nationals or third country nationals with a valid residence permit, employed by Foreign Missions in Turkey should be covered with social insurance.

             The 2^nd Article of the Law states that “Worker who has been employed by one or more employers based on a contract of services, is referred as ‘insured person’ according to this Law”.

The 79^th Article of the Law states that “The employer is responsible for supplying the Institution (SSK) with monthly contributions of the insured, Total insurable earnings for support contribution, number of days for contribution payment and original or additional records showing these contributions whose samples are determined by regulations until the end of the month following the quarter that the records belonged to. Furthermore, the employer is responsible for presenting workplace records when demanded by the Institution and if there are no insured are employed, the employer is responsible for declaring this issue in a written format in one month following the termination of the insured’s employment to the Institution”.

            The 80^th Article of the Law stipulates that “The employer shall be bound to withhold the contributions to be calculated under this Act, on the basis of the total amount of wages which are due to the insured persons in the course of any month and shall pay the sum of all such liable contributions, include his own share, to the Institution not later than the end of the following month”.

The Ministry of Foreign Affairs of the Republic of Turkey avails itself of this opportunity to renew to All Foreign Missions Accredited to Turkey the assurances of its highest consideration.
