QA-8, 9 April 2014, Statement of the Spokesman of the Ministry of Foreign Affairs in Response to a Question Regarding the Decision of the Berlin Higher Administrative Court on Visa-free Entry of a Businessman to Germany

A Turkish businessman, Mr.Osman Nuri Korca, residing in Istanbul, travelled to Germany to provide services for Siemens in 2010. Upon refusal of entry into the country at Düsseldorf Airport on the grounds that he had obtained his Schengen visa from France, he filed a lawsuit before German courts to defend his rights.

The case was appealed upon the decision of the Berlin Administrative Court on 12 March 2012, stating that Mr. Korca should have entered the territory after having obtained an employment visa. The second instance court, the Higher Administrative Court of Berlin Brandenburg decided, on 26 March 2014, that Mr. Korca may stay in Germany as a service provider without visa for a maximum period of three months. The judicial process has not been completed and the decision is not yet final.

On the other hand, the Visa Liberalization Dialogue between Turkey and the European Union was launched on 16 December 2013. The goal of this process is to provide visa exemption for all Turkish citizens, including businessmen. After the finalization of this process with the EU, Turkish citizens, irrespective of their being service providers or receivers, will have the right to travel to Schengen countries without visa for stays not exceeding 90 days.
