No: 252, 25 July 2014, Press Release Regarding the German Language Knowledge Requirement Imposed by Germany as a Condition for Turkish Nationals to move to Germany following their Marriage

The Court of Justice of the European Union (CJEU), in its judgment issued on 10 July 2014, ruled that the German Language knowledge requirement for the purpose of reunification of spouses of Turkish nationals residing in Germany, as introduced by changes made to the law in 2007 in Germany, in terms of its implementation for Turkish nationals, is a violation of the prohibition to introduce new restrictions on the freedom of establishment as provided in Article 41, paragraph 1 of the Additional Protocol signed between Turkey and European Economic Community (EEC) on 23 November 1970. 

The Court of Justice of the European Union reaffirmed with this judgment that the provision in question, which we believe to be incompatible with fundamental rights and freedoms in terms of protecting the family unity and from which nationals of many countries such as the U.S. and Japan as well as the nationals of the EU member States are excluded, restrict the rights of Turkish nationals arising from the Partnership Law between Turkey and the EU.

We welcome this judgment rendered by the Court of Justice of the European Union.

We expect from the German authorities to start to enact and implement the necessary legal and administrative arrangements to end the plight of our citizens in line with the decision of the CJEC.
